Partit Demokratiku welcomes the amendment to the Criminal Code which was moved last Wednesday in Parliament. The law to be amended saw a person sentenced to 5 years imprisonment for having involuntarily killed a man and injured his sister in a traffic accident in 2011
The removal of the minimum penalty, which was triggered in the recent case, leaves it up to the discretion of the magistrate presiding over the case to sentence offenders as he/she deems fit and according to case law.
Partit Demokratiku believes that while sentences for criminals should be tough, it also understands that some people are victims of circumstances, and this should be taken into account when judgement is passed.
Il-Partit Demokratiku jilqa’ l-emenda fil-liġi tal-Kodici Kriminali li ġiet imressqa nhar l-Erbgħa fil-Parlament. Din l-istess liġi kkundanat peruna 5 snin priġunerija fuq qtil involontarju ta` raġel u korriment fuq oħtu f’inċident ta` traffiku li seħħ fl-2011.
Bit-tneħħija tal-infurzar fuq l-inqas penali bil-liġi, d-deċizjoni taqa’ f’idejn il-magistrat biex jgħati/tgħati sentenza xierqa skont il-każ li jkun prezentat.
Għalkemm il-Partit Demokratiku jemmen li sentenzi fuq reati kriminali għandhom ikunu ħorox, jifhem ukoll li f’certu każijiet persuna tista tkun vittma taċ-cirkustanzi, u dawn għandhom jitqiesu meta tkun se tingħata sentenza.
